Illinois Department of Agriculture Publishes Proposed Industrial Hemp Rules

The Illinois Department of Agriculture has published administrative rules for the public to comment on regarding the production of industrial hemp in Illinois. The following 45 day period is open to public comments. Afterwards, applications to apply for licensing will be available to farmers and processors. Fees include $100 per application, $1,000 per license, and lab testing will be charged at cost.

The Ninth Circuit Court of Appeals denied the petitioners petition to review DEA’s Final Rule for the “Establishment of a New Drug Code for Marihuana Extract.” While accepting the legitimacy of the 2014 Farm Bill amendment that allows for research on industrial hemp, the court is denying that the Final Rule interferes with activities that revolve around cultivation, production, and sales of products that include cannabinol (CBD).
